Audiovisual Agreement and Waiver

This Audiovisual Agreement and Waiver sets forth additional terms and conditions of your use of the https://sarahschlote.com website, online store, and its related products and services, including but not limited to psychotherapy, demonstrations, personal sessions for student credit hours, and consultations (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and the Schlote Psychotherapy Professional Corporation, operating under various trade or business names including but not limited to EQUUSOMA® (“we”, “us” or “our”).

By using this Website and accessing the Services provided by Sarah Schlote and the Schlote Psychotherapy Professional Corporation, you indicate that you accept this Agreement and Waiver and that you accept and agree to abide by it. If you do not agree to the audiovisual terms and conditions below, please immediately cease all usage of this Website and its Services.

This Agreement remains in effect even after your account is terminated or you have stopped using our Website and Services.

General overview

Personal psychotherapy appointments are not usually recorded, unless previously agreed to in writing by Sarah Schlote and the client (or the person whose animal(s) feature in the session). If agreed upon and consented to, recordings of personal sessions with private psychotherapy clients may only be used for the clients’ own personal reference (and may not be shared or distributed publicly or privately or used in any way to harm, slander, or defame), in accordance with applicable laws, legislation, and standards of practice governing the practice of psychotherapy.

Demonstrations or personal sessions for credit hours featuring the practical application of various methods and techniques involving participating people and/or animals may be recorded for educational purposes (whether recorded live in front of an audience or privately) in order to support the training and development of other professionals.

Small group case consultations are not recorded. Large group case consultations may be recorded for the purposes of documentation and record keeping. Recordings of portions of large group case consultations that do not breach confidentiality (such as teaching concepts or general questions) may be distributed or made available for resale. Professional standards around confidentiality apply. We cannot confirm that any particular student, participant, or consultee will or will not appear in the final recordings.

Unauthorized recordings (audio, video, or otherwise) and photographs are not permitted during any Service or Event offered by Sarah Schlote and the Schlote Psychotherapy Professional Corporation. The use of screen recording technology to copy videos produced from these Services is prohibited. Sarah Schlote and the Schlote Psychotherapy Professional Corporation will not be liable or responsible for any unauthorized recording or photography of sessions, webinars, consultations, or other Services, or use or exploitation thereof.

Agreement and waiver

For good and valuable consideration, and in exchange for my receipt of my registration payment, I, the undersigned, for myself, and on behalf of any other individuals (including minors) for whom I have legal capacity to consent (collectively hereinafter, the “Undersigned”), hereby agree as follows:

Consent to Photography, Filming and Recording: I irrevocably authorize and provide consent to the Schlote Psychotherapy Professional Corporation, and its employees, agents, representatives, subcontractors and affiliates, and all of their successors and assigns, (collectively hereinafter, the “Producers”) to photograph and/or film and/or audio record the Undersigned during the Undersigned’s voluntary participation in their Services without limitation (“Activities”), with the exception of private psychotherapy sessions and consultations as described above. Any prior photographing, filming, and/or audio recording of the Undersigned by the Producers during the Undersigned’s voluntary participation in Activities is incorporated within this Agreement and Waiver.

Consent to Use: I authorize the Producers to use, including reproduction, exhibition, distribution, licensing, posting on social media, etc. (“Use”) any photographs, images, or recordings taken by the Producers of the Undersigned under authority of this Agreement and Waiver, including without limitation, the Undersigned’s name and/or likeness and/or voice (collectively hereinafter, the “Photos and Recordings”), in educational courses and related activities, as well as in pamphlets, brochures or other materials promoting educational programs and related activities, such as multimedia productions, displays, advertisements or internet publications (“Publications”). I understand that the Producers do not tag people in social media posts without their prior consent.

Release of Claims: I release and forever discharge the Producers from and against any and all claims and demands arising out of, or in connection with, their Use of Photos and Recordings of the Undersigned.

Waiver: I further waive all copyright interest, including moral rights, and any rights to claim royalties, or other form of compensation or interest arising from the Producers’ use of the Photos and Recordings.

Declaration: I declare, as the Undersigned, that I am of the full age of majority (i.e., at least 18 years of age), I have legal capacity and authority to consent to matters herein on my own behalf and on behalf of any other individuals listed below, and that by using this Website and registering for the aforementioned Services I understand and consent to the contents of this Agreement and Waiver as a legally binding document. I confirm that I have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services I agree to be bound by this Agreement. If I do not agree to abide by the terms of this Agreement, I understand that I am not authorized to access or use the Website and Services.
